All services are subject to availability and dependent on the current weather conditions. We hold the right to alter or cease services when necessary.
3. Booking and Reservations
3.1 Booking Process
Charter booking prerequisites include:
- Minimum age requirement of 18 years
- Submission of valid and complete particulars
- Payment of an outlined deposit as indicated in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed once the payment is received and we provide written acknowledgement. We have the discretion to deny service to any individual.
3.3 Availability
Charter availability is contingent upon the accessibility of the yacht and favorable weather conditions. We strive to accommodate your preferred scheduling upon reasonable effort.
4. Payment Terms
4.1 Pricing
Quoted prices are in £ and tax inclusive unless specified otherwise. Rates are subject to modifications without prior notification.
4.2 Payment Schedule
- Deposit: A 50% payment of the total charter cost is required at the time of booking
- Balance: Due 48 hours prior to the charter departure
- Additional charges (if any): Payable following the completion of the charter
4.3 Payment Methods
Acceptable forms of payment include major credit cards, bank wire transfers, and certified cheques. All payments are processed securely, with encrypted handling.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: A full refund less any processing charges
- Between 24 to 72 hours before departure: A 50% refund
- Less than 24 hours prior to departure: Non-refundable
5.2 Weather Cancellations
If our captain deems the weather conditions unsafe, we propose to:
- Reschedule the charter to a subsequent available slot at no extra charge
- Process a full refund if rescheduling is unachievable
5.3 Mechanical Issues
In the event your designated yacht encounters mechanical issues, we will endeavor to supply an appropriate substitute. If this cannot be accomplished, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed the instructions of the crew
- Utilize provided safety gear as necessary
- Disclose any medical conditions that might affect their security
- Remain within authorized areas on board the yacht
6.2 Prohibited Items
Items not permitted aboard include:
- Glassware
- Illegal substances
- Firearms or other weapons
- Excessive non-alcoholic drinks beyond moderate consumption
- Pets (except when pre-approved)
6.3 Conduct
All passengers should behave respectfully. We maintain the right to cease a charter without a refund if the conduct of a passenger endangers safety or hinders the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the charter fee paid. We shall not be liable for:
- Injury resulting from personal negligence
- Status or damage to private belongings
- Indirect or ensuing damages, or punitive damages
- Postponements due to weather or other circumstances outside our control
7.2 Insurance Coverage
Comprehensive marine insurance is in place for our fleets and their operations. It is your duty to ensure personal and travel insurance coverage.
7.3 Assumption of Risk
You acknowledge the intrinsic dangers involved in marine activities and accept full responsibility for your personal security while engrossed in our chartered services.
8. Modifications and Itinerary Changes
Our prerogative includes making adjustments to itineraries, travel paths, or schedules responding to meteorological elements, safety measures, or operational requirements. We commit to providing adequate alternative options wherever feasible.
9. Force Majeure
Occurrences beyond our command such as severe climatic conditions, natural catastrophes, governmental edicts, harbor discontinuances, and mechanical failures exempt us from liabilities related to the disruptions, cancellations, or adjustments thus caused.
10. Privacy and Data Protection
Your private data will be managed according to our Privacy Policy. Your utilization of our services signifies agreement with the data collection and usage as outlined in said policy.
11. Intellectual Property
Our website's content, including texts, visuals, logos, and imagery, is covered by copyright and trademark regulations. Unauthorized reproduction, dissemination, or creation of derivative work requires our express consent.
